All banks and most financial institutions across New Zealand need to make sure that they comply with the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 (“Act”). But what does that actually mean?
What is it?
Firstly, the definitions:
- Money laundering is the process of disguising illegal money to make it look like it has been derived from a legitimate source, and
- Financing terrorism is the process of disguising the origin of legitimate funds for use in terrorist activities.
Using these definitions, New Zealand introduced the Anti-Money Laundering and Countering Financing of Terrorism Act in 2009. This means New Zealand’s financial institutions are obligated to detect and deter money laundering and terrorism financing, and take appropriate measures to guard against these risks.
As well as enhancing the reputation of individual businesses, this helps position New Zealand as a safe place in which to do business.
What does it mean?
If a business is defined as a reporting entity, such as a bank or financial institution, there are a number of requirements:
- A risk assessment identifying and assessing the risks a business might reasonably expect to face
- A compliance programme that sets out the internal policies, procedures and controls necessary to detect money laundering and the financing of terrorism, and mitigate the risk of it occurring
- A Compliance Officer appointed to administer and maintain the programme
- Customer due diligence processes including customer identification and verification of identity
- Suspicious transaction reporting, auditing and annual reporting systems and processes.

How does it affect you?

The types of documents key personnel may be asked to provide to verify their identity may vary for different transactions or services, and across different service providers. Examples of verification include a passport, birth certificate and/or drivers licence, either sighted face to face or certified by a trusted referee.
